These Terms of Service ("Terms") govern your access to and use of Chainage, including the web app at chainage.com.au, the installable app, share links, and related websites and support (together, the "Service"). The Service is provided by TekSwipe Traffic of Queensland, Australia ("TekSwipe Traffic", "we", "us" or "our").
01About these terms
By creating an account, signing in, opening a share link or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Service.
You must be at least 18 years old to create an account. If you use the Service on behalf of a company, government agency, council or other organisation, you confirm that you have authority to bind that organisation to these Terms, and "you" includes that organisation.
If you have a separate written agreement with us (for example, a Government plan agreement or purchase order terms we have accepted in writing), that agreement prevails over these Terms to the extent of any inconsistency.
02The service
Chainage is a mobile-first web application that helps people locate and record positions on Queensland's state-controlled road network. Depending on your plan, it lets you:
- find the approximate chainage, road name, section, carriageway and distance to road for a location you tap, search for or obtain from your device's GPS;
- view map layers, base maps, Street View imagery and traffic, speed and heavy-vehicle route information drawn from third-party sources;
- save points, dropped pins and chainage ranges into projects, with phases, layers, notes, links, photos and files;
- organise projects into folders and tags, keep a project hub with details, files and an activity log, and export project data; and
- share projects through share links and invitations, and collaborate in company workspaces with roles and permissions.
Some features require an account or a paid plan. The features included in each plan are described on our pricing page and may change as described in section 12.
03Accounts and security
- You must give us accurate information when you register and keep your email address up to date — it's how we send important notices, including retention reminders.
- Keep your password confidential and don't share your account. Each person should have their own login.
- You are responsible for everything that happens under your account unless it results from our failure to take reasonable security measures.
- Tell us promptly at support@tekswipe.com.au if you suspect unauthorised access to your account or a share link.
- We may require you to reset your password or temporarily lock an account if we reasonably suspect it has been compromised.
04Plans, pricing and payment
Plans and the free tier
We offer a free plan (Starter) and paid plans (currently Professional, Business and Government). The Starter plan is subject to limits, including a maximum number of projects and a storage allowance, as shown on the pricing page. We may change free-plan limits on reasonable notice; if a change affects content you already hold, we will tell you in advance and nothing will be deleted because of the change alone.
Prices and GST
All prices are in Australian dollars (AUD) and include GST unless stated otherwise.
Subscriptions and automatic renewal
Paid plans are subscriptions billed monthly in advance. Your subscription renews automatically each month and you authorise us to charge your nominated payment method for each renewal until you cancel.
Payment processing
Card payments are processed by Stripe, our payment provider, under Stripe's own terms. We don't receive or store your full card number. Government plan customers may request invoicing, in which case invoices are payable within the time stated on the invoice.
Seats and viewers
On team plans (Business and Government), the company owner pays for a seat for each member who holds a paid seat in that company. Viewers — people who only view share links or projects shared with them — do not need a paid seat. Each company pays for its own seats, even if the same person is a member of several companies.
Storage packs
Paid plans can add storage packs (currently 50 GB for $19 AUD per month each). Storage packs are billed with your subscription and renew and cancel on the same cycle. On team plans, packs add to the company's pooled storage.
Upgrades, downgrades and seat changes
You can upgrade, downgrade or change your number of seats or storage packs at any time. Changes take effect immediately and are prorated, meaning you are charged or credited for the difference for the remainder of the current billing period. If a downgrade takes you over your new plan's limits, content beyond those limits becomes read-only until you are back within the limits; nothing is deleted because of the downgrade alone.
Storage limits
If you reach your storage limit, new uploads pause until you free up space, upgrade or add a storage pack. Existing content is not deleted.
Failed payments
If a payment fails, we (or Stripe) will retry it and notify you. If payment is still outstanding 14 days after our first notice, we may suspend paid features or downgrade the account to Starter limits until payment is made. We won't delete your data because of a failed payment alone — our retention rules continue to apply.
Cancellation
You can cancel a subscription at any time in the app or by emailing us. Cancellation takes effect at the end of the current billing period — your plan stays active until then and is not renewed. After that, your account moves to Starter limits and content beyond those limits becomes read-only.
Refunds
Subscription fees are not refundable for partial billing periods or unused features, except where a refund is required under the Australian Consumer Law or another law that cannot be excluded, or where we decide otherwise at our discretion. If we terminate your subscription for convenience (not because of your breach), we will refund any prepaid fees for the unused portion of the period.
Price changes
We may change our prices. We will give you at least 30 days' notice by email or in the app before a price change affects your subscription. The new price applies from your first billing date after the notice period. If you don't want to pay the new price, you can cancel before it takes effect.
05Companies and teams
- The owner is responsible. The person who creates a company (the "owner") is responsible for the company's subscription, seats and compliance with these Terms by its members. Ownership can be transferred to another member.
- Owners and admins control access. The owner and anyone with the relevant permissions decide who is a member, what role each member has, and what each role can do, including who can create or delete projects, manage share links, create links without a password, manage billing or export data.
- Company content belongs to the company. Projects, files and other content created in or moved into a company workspace belong to that company (or the organisation it represents), not to the individual member who created them.
- When a member leaves. If a member leaves or is removed, company projects stay with the company. The member loses access to company content but keeps any personal projects in their own account.
- Visibility. Company owners and admins may be able to see company project content and member activity within the company, such as the project activity log.
- Several companies. A person may belong to several companies. Each company's content, seats and billing are separate.
06Acceptable use
You must use the Service lawfully and responsibly. You must not, and must not help anyone else to:
- use the Service for any unlawful, fraudulent or harmful purpose, or in breach of anyone's rights;
- copy, modify, decompile, disassemble or reverse engineer the Service or its software, except to the extent the law allows despite this restriction;
- scrape, crawl, harvest or bulk-extract data from the Service (including the road network, chainage, traffic or speed datasets it presents), or use the Service to build a competing product or dataset — use the original open data sources instead;
- probe, scan or test the vulnerability of the Service, or attempt to breach or bypass any security, authentication, rate limit, share-link password or access control;
- overload, disrupt or interfere with the Service or its infrastructure, including through automated requests at a volume a person using the app normally could not generate;
- upload or share malware, or any content that is unlawful, defamatory, harassing, discriminatory, obscene, or that infringes anyone's intellectual property or privacy;
- upload photos or files containing other people's personal information unless you are allowed to collect and share it;
- access another person's account or content without permission, or misrepresent your identity or affiliation; or
- resell, sublicense or provide the Service to third parties as a service, except for sharing your own projects as the Service intends.
We may investigate suspected breaches and take reasonable action, including removing content, revoking share links or suspending accounts, as described in section 14.
07Your content
"Your content" means the data you or your team put into the Service — projects, points, pins, ranges, notes, links, photos, files, comments and similar material.
- You own your content. We don't claim ownership of it (subject to section 5 for company content).
- Licence to us. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit, display and back up your content only as needed to provide, secure and support the Service, and to comply with law. This licence ends when your content is deleted from the Service and our backups, as described in the retention policy.
- Your responsibility. You are responsible for your content and for having all rights and permissions needed to upload it — for example, permission to use photos and documents, and to collect any personal information they contain.
- Sharing is your choice. You control what you share. You are responsible for who you invite, the share links you create, and the content those links expose.
A share link without a password can be opened by anyone who has the link, and links can be forwarded. Password-protect links to sensitive projects, use expiry dates, limit links to the phases and layers people need, and revoke links you no longer need.
We may remove or disable access to content that we reasonably believe breaches these Terms or the law, or that we are legally required to remove. Where appropriate, we'll tell you why.
08Safety and data accuracy
Chainage is an aid only. It must not be relied on as the sole source of information for traffic guidance schemes (TGS), traffic management plans (TMP), or any safety-critical, legal, engineering or survey decision.
Chainages, road names, sections, carriageways, traffic volumes (AADT), heavy-vehicle percentages, speed signs, posted speed limits (including OpenStreetMap data), heavy-vehicle route information and map imagery come from third-party open data and services, including the Queensland Department of Transport and Main Roads (TMR), OpenStreetMap contributors, the National Heavy Vehicle Regulator (NHVR) and Google. That information:
- may be incomplete, out of date, simplified or inaccurate, and may not reflect recent roadworks, realignments, speed changes or restrictions;
- is matched to your location by calculation, so chainages and positions are approximate and can be affected by GPS accuracy, device settings, network geometry and map projection; and
- may be unavailable at times, or change without notice.
You must always verify critical information against official TMR sources and records, on-site conditions, and the applicable standards and guidelines — for example, the Queensland Manual of Uniform Traffic Control Devices (MUTCD), the Austroads Guide to Temporary Traffic Management (AGTTM) and any Queensland supplements — and use appropriately qualified people. You remain responsible for your designs, plans, approvals and work on site.
Do not use Chainage while driving. Live GPS tracking is designed for passengers. If you're driving, stop in a safe, legal place before looking at or interacting with the app, and always obey road rules and site safety requirements.
Chainage is an independent tool. It is not affiliated with, endorsed by or an official product of the Queensland Department of Transport and Main Roads or any other government body.
09Third-party services and data
The Service relies on third-party data and services, which are subject to their own terms and licences. By using the relevant features you agree to use them in line with those terms. In particular:
- Queensland Government data. Road network, chainage, traffic and speed-sign data from the Department of Transport and Main Roads is used under the Creative Commons Attribution 4.0 (CC BY 4.0) licence. © State of Queensland (Department of Transport and Main Roads).
- OpenStreetMap. Posted speed limits and some map data are © OpenStreetMap contributors and available under the Open Database Licence (ODbL). When you tap "More information", your selected location is sent to an OpenStreetMap (Overpass) service to look up nearby data.
- OpenFreeMap. Vector map tiles are provided by OpenFreeMap and are built from OpenStreetMap data.
- NHVR. Heavy-vehicle route access information is provided by the National Heavy Vehicle Regulator and is subject to the NHVR's terms. Your selected location is sent to the NHVR's service when you request it.
- Google. Google Maps base maps, satellite imagery and Street View are provided by Google and are subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
- Stripe processes payments, and DigitalOcean hosts the Service and stores files in Sydney, Australia.
We're not responsible for third-party services or data, or for changes to them, and they may be withdrawn or changed by their providers. Links to third-party websites are provided for convenience only.
10Our intellectual property
We (and our licensors) own all rights in the Service, including its software, design, look and feel, compiled data, documentation, and the Chainage and TekSwipe Traffic names and logos. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own (or your organisation's) internal business purposes. No other rights are granted. Third-party data remains subject to its own licence.
11Feedback
We love hearing how the Service could be better. If you send us ideas, suggestions or feedback, you agree we may use them freely without any obligation to you. Feedback doesn't include your content.
12Availability and changes to the service
- We work hard to keep the Service available and fast, but we don't guarantee it will be uninterrupted, error-free or available in areas with poor mobile coverage. Please plan for the Service being unavailable at critical moments.
- We may carry out scheduled or emergency maintenance, and will try to do so at times that minimise disruption.
- We continually improve the Service and may add, change or remove features. If we remove a material feature of a paid plan, we'll give you reasonable notice and, if you cancel as a result, refund any prepaid fees for the unused period.
- We may offer beta, preview or experimental features. They're provided as-is, may change or be withdrawn at any time, and may be less reliable than the rest of the Service.
13Data retention and deletion
We keep your account and content while your account is active. To avoid holding data indefinitely, inactive accounts may be deleted under our data retention and storage policy. In summary:
- Inactivity means no sign-in and no other account activity.
- Free (Starter) accounts inactive for 2 years, and accounts that have previously held a paid plan (or belong to a company that has paid) inactive for 3 years, may be deleted along with their projects, photos and files.
- We send reminder emails to your account email address before deletion, and signing in resets the clock.
- Accounts with an active paid subscription are not deleted for inactivity.
You can ask us to delete your account and data at any time. Before closing an account or cancelling, export anything you want to keep — deleted data cannot be recovered once removed from our backups.
14Suspension and termination
By you
You can stop using the Service at any time, cancel your subscription as described in section 4, and ask us to delete your account.
By us
We may suspend or terminate your access to all or part of the Service, or revoke share links, if:
- you materially breach these Terms and (if the breach can be fixed) don't fix it within 14 days of our notice;
- fees remain unpaid as described in section 4;
- we reasonably believe it is necessary to prevent harm to the Service, other users or the public, to respond to a security incident, or to comply with the law or a lawful request; or
- we decide to discontinue the Service, in which case we will give at least 60 days' notice where practicable, give you a chance to export your data and refund prepaid fees for the unused period.
Where reasonable, we'll notify you before suspending and restore access once the issue is resolved. Sections that by their nature should survive termination (including those on fees owed, content licences needed for deletion and backups, intellectual property, disclaimers, liability, indemnity and general terms) survive.
15Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee or warranty that cannot lawfully be excluded, including the consumer guarantees under the ACL.
Where the law allows us to limit our liability for a failure to comply with a consumer guarantee (for example, where the services are not of a kind ordinarily acquired for personal, domestic or household use), our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
16Disclaimers
To the extent permitted by law and subject to section 15, the Service is provided "as is" and "as available". We make no warranty or representation that the Service or any data it presents is accurate, complete, current, fit for a particular purpose, or will meet your requirements, and all implied warranties are excluded to the extent the law allows. Your use of the Service and its information is at your own risk, as described in section 8.
17Limitation of liability
To the maximum extent permitted by law and subject to section 15:
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, contracts, goodwill, data or anticipated savings, however it arises;
- we are not liable for any loss arising from reliance on third-party data or from decisions made using the Service without the verification described in section 8; and
- our total aggregate liability arising out of or in connection with the Service or these Terms, whether in contract, tort (including negligence), statute or otherwise, is limited to the total fees you paid us for the Service in the 12 months before the event giving rise to the claim (or $100 AUD if you have used only the free plan).
Our liability is reduced to the extent any loss is caused or contributed to by you, your personnel or third parties. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud.
18Indemnity
You indemnify us against any claim, loss, liability, damage, cost or expense (including reasonable legal costs) that we suffer or incur arising from a third-party claim caused by your breach of these Terms, your content, or your unlawful or negligent use of the Service — except to the extent the loss was caused by our own breach, negligence or wilful misconduct.
19Privacy
Our Privacy Policy explains how we collect, use, store and disclose personal information, including our data retention and storage policy. If you upload personal information about other people (for example, in photos or files), you are responsible for complying with privacy laws that apply to you.
20Changes to these terms
We may update these Terms from time to time, for example to reflect new features, legal requirements or changes to our pricing. We'll update the "last updated" date and, for material changes, notify you by email or in the app at least 30 days before they take effect (or sooner where required by law or for security reasons). If you keep using the Service after the changes take effect, you accept the updated Terms. If you don't agree, you can stop using the Service and cancel your subscription before the changes apply.
21General
- Entire agreement. These Terms, the Privacy Policy and any plan details shown at purchase are the entire agreement between you and us about the Service.
- Severability. If any part of these Terms is invalid or unenforceable, it is read down or severed to the extent necessary, and the rest continues in force.
- Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign or novate them to a successor to our business on notice to you, provided your rights are not materially reduced.
- No waiver. A failure or delay in exercising a right is not a waiver of it.
- Notices. We may give you notices by email to your account email address or in the app. You can give us notices by email to support@tekswipe.com.au.
- Force majeure. We're not liable for delays or failures caused by events beyond our reasonable control, such as outages of third-party providers, natural disasters or telecommunications failures.
- Governing law. These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and courts that can hear appeals from them.
- Disputes. If you have a concern, please contact us first — most issues can be resolved quickly and informally.
